1. About the site
WN Conseil, a single-member limited liability company (EURL) with capital of €1,000.00, registered with the Nanterre Trade and Companies Register under number 929 812 642. Registered office: Bureau 3, 6 Rue des Bateliers, 92110 Clichy, France · E-mail: contact@tempassur.com · ORIAS number: 24004933 (www.orias.fr). WN Conseil acts as an insurance broker (ORIAS no. 24004933). Insurance contracts taken out via the TempAssur site are concluded between the customer and the insurance company underwriting the risk (its name appears on the contractual documents), with WN Conseil acting as an intermediary and not a party to the insurance contract. These terms and conditions of sale govern sales made on the TempAssur site.
2. Purpose
The purpose of these terms and conditions of sale is to define the rights and obligations of the parties in connection with the online sale of temporary insurance products offered on the TempAssur site.
3. Acceptance of the terms and conditions of sale
Any order placed on the TempAssur site implies full and unreserved acceptance of these terms and conditions of sale. The customer declares having read them before placing an order.
4. Products and services
TempAssur offers temporary insurance products suited to different types of vehicles. The essential features of the products are described on the site. It is the customer's responsibility to ensure that the chosen product meets their needs. Before any subscription, the customer receives the insurance product information document (IPID) as well as the general contract terms. Eligibility conditions (minimum age of 21, driving licence held for at least 2 years, declarations regarding history) are checked at subscription; any false declaration exposes the policyholder to the penalties set out in articles L.113-8 and L.113-9 of the French Insurance Code.
5. Order
Orders are placed online, via the TempAssur site. The customer must select the desired insurance product, fill in the required information, and confirm the order. Confirming the order implies acceptance of the prices and descriptions of the products, as well as of these terms and conditions of sale, and includes express acceptance of the driver declarations presented before payment. The customer then receives a confirmation e-mail for their order.
6. Price
Prices displayed on the TempAssur site are shown in euros and include VAT applicable on the day of the order. WN Conseil reserves the right to change its prices at any time, but products will be invoiced based on the rates in effect at the time the order is confirmed.
7. Payment
Payment is made by bank card or any other means indicated on the site. The customer guarantees that they are fully authorised to use the chosen means of payment. The order amount will be charged when the order is confirmed.
8. Right of withdrawal
Due to the temporary nature of the insurance contracts offered on the TempAssur site, the customer expressly waives their right of withdrawal. Once the contract has been taken out and cover is in effect, no cancellation or refund will be possible. The customer acknowledges that the contract runs for a fixed term with no automatic renewal, and therefore cannot be terminated.
9. Liability
WN Conseil undertakes to provide products that comply with applicable legal provisions. However, WN Conseil cannot be held liable for indirect damages resulting from the use of products sold on the site.
10. Personal data
Information collected by WN Conseil when an order is placed is necessary for processing that order. It is processed in accordance with data protection legislation. The customer may exercise their rights of access, rectification and deletion of their data by contacting WN Conseil.
11. Amendments to the terms and conditions of sale
WN Conseil reserves the right to amend these terms and conditions of sale at any time. The applicable conditions are those in effect at the time of the order.
12. Governing law and disputes
These terms and conditions of sale are governed by French law. In the event of a dispute relating to an order or the application of these terms and conditions of sale, the customer is invited to contact WN Conseil's customer service to attempt to resolve the dispute amicably. For disputes relating to an insurance contract, the customer may refer the matter free of charge to La Médiation de l'Assurance: www.mediation-assurance.org Pôle CSCA, TSA 50110, 75441 Paris Cedex 09. For other disputes relating to the site, the designated consumer mediator is the IEAM (Institut d'Expertise, d'Arbitrage et de Médiation): 31 bis – 33 rue Daru, 75008 Paris www.ieam.eu contact@ieam.eu. In the event of legal proceedings, the competent courts will be those of the jurisdiction where WN Conseil's registered office is located.
